Education On The Legality Of Solvent Traps

Solvent Trap Co. is selling (sells) parts and products for solvent traps. Solvent traps are classified as a “firearm accessory,” as such they can be attached to the end of the barrel of a firearm, with an adapter, as a cleaning accessory and are not considered as anything other than an accessory. This is because a projectile, or bullet, cannot pass through the tube without modification.

Solvent traps and/or solvent trap kits can be purchased legally without a Form 1. However, you cannot alter, redesign or modify solvent traps into a device for silencing, muffling or diminishing the report of a firearm without first filing a Form 1, and then receiving back an approved Form 1 from the BATFE. Please be aware and fully understand the restrictions and regulations.

To help with a better understanding, here is a reiteration the above in more words: Solvent traps can be purchased and owned legally without a Form 1. However, you cannot alter, redesign or modify solvent traps into a device for muffling, silencing, or diminishing the report of a firearm without first filing and receiving back from BATFE an approved Form 1. It is important to be aware of the restrictions and regulations.

Only after receiving back an approved Form 1 from the BATFE, can you make any modifications to the product. A crime is committed if you make any alterations or any modifications to a solvent trap PRIOR to obtaining the required tax stamp. Please allow this information to serve as a felony alert! Do not make any alterations or modifications to our products, prior to receiving back your approved Form 1. (i.e: getting the approved Form 1 back from the BATFE)

The stated intent of a solvent trap is to catch and trap gun cleaning solvent during bore cleaning operations commonly performed on firearms. Solvent traps do attach to the muzzle of a firearm but do not have any design features intended to allow a bullet to pass through them.

Since as originally manufactured they are not intended to silence, muffle or diminish the report of a portable firearm they are not silencers as defined in 18 U.S.C. 921(a)(24) and thus also are not firearms as defined in 18 U.S.C. 921(a)(3) or 26 U.S.C. 5845(a)(7).

However, if the solvent trapped was redesigned or utilized to assemble a device for silencing, muffling or diminishing the report of a portable firearm or if intent was demonstrated to use the device for silencing, muffling or diminishing the report of a portable firearm, the solvent trap would be classified as a “firearm silencer” as defined in 18 U.S.C. § 921(a)(24) and as a “firearm” as defined in 18 U.S.C. § 921(a)(3)(C) and 26 U.S.C. § 5845(a)(7).

Our products are sold in compliance with BATFE and not as NFA products. Our solvent trap end caps and cups are not center-marked and solvent traps are unregulated.
